Welcome to PowerPlayer, operated by The Power Player, Inc. ("PowerPlayer," "we," "us," or "our"). PowerPlayer is a one-way communication service that lets coaches deliver developmental feedback to athletes and their parents. This Privacy Policy ("Policy") describes how we collect, use, disclose, and protect information in connection with our website, mobile applications, and related online services (collectively, the "Services"), and the choices available to users. This Policy forms part of, and is incorporated into, the PowerPlayer Terms of Service. Capitalized terms not defined here have the meaning given in the Terms of Service.
 

By accessing or using the Services, you acknowledge that you have read and understood this Policy. If you do not agree with it, do not access or use the Services.

1.  Jurisdictional scope

PowerPlayer is offered to educational agencies, sports organizations, coaches, athletes, and parents located in the United States and Canada, and is intended for use by data subjects located in the United States and Canada. The Services are not offered to, marketed to, or intended for data subjects located in the European Union, European Economic Area, Switzerland, or the United Kingdom, and we do not target or monitor data subjects in those regions. Personal information is handled under the data-protection law of the jurisdiction in which the data subject is physically located at the time of processing, not the jurisdiction of their citizenship. A data subject physically located in the United States or Canada (including, for example, a foreign-exchange student attending a US or Canadian educational agency) is handled under the applicable US or Canadian framework.

2. Information we collect

a. Information you provide to us. When you register for a PowerPlayer account, or correspond with us, we collect information such as first and last name, email address, and (optionally) phone number, together with a display name and, if you choose, a profile picture. We may retain the messages and content you send through the Services.

 

b. Information about athletes and teams. Coaches create teams and add athletes and, for minor athletes, their parents. For an athlete we may hold: name; date of birth; email address (which, for a minor without an individual login, may be a system-generated placeholder address); jersey number; playing position(s); height and weight and similar sport attributes; the developmental messages and media a coach sends; a coach's free-text notes; and event RSVP/attendance. Parents linked to a minor athlete can view coach-to-athlete communications.

 

c. Payment information. Team subscriptions are processed by our payment processor, Stripe. We do not store full payment-card numbers, card verification values, or bank-account details; we retain only a customer/subscription reference and payment status needed to manage billing.

 

d. Information collected automatically. We collect limited technical information necessary to operate and secure the Services — for example, device push-notification tokens and operating-system type, last-login timestamps, and crash and error diagnostics. We do not use this information for advertising or profiling (see Section 4).

3. How we use information

We use the information we collect to: • operate, maintain, and provide the Services and their features;

• deliver coach developmental feedback to the intended athletes and their linked parents;

• authenticate users and secure accounts;

• communicate with you about the Services, including administrative and transactional messages;

• process team subscriptions through our payment processor; and

• comply with legal obligations and enforce our agreements.

 

We do not use personal information for any purpose incompatible with these purposes, and, for data processed on behalf of an educational agency, we use it solely to provide the Services to that agency.

4. Advertising, sale of data, and profiling

No advertising or profiling. For users associated with an educational agency, team, coach, athlete, or parent account, The Power Player, Inc. does not serve advertising, does not use personal information for targeted advertising, and does not build advertising or behavioral profiles of students. No third-party advertising software development kits (SDKs) are integrated into the application.

 

No sale of data. Personal information collected on behalf of an educational agency is not sold and is not treated as a transferable business asset. In any change of control (merger, acquisition, financing, or similar transaction), such information remains subject to the applicable data-privacy agreement and is transferred only to a successor that is bound by obligations at least as protective, or is returned or deleted.

5. How we share information

We share personal information only as needed to provide the Services:

• Within a team or educational agency. Coaches, athletes, and linked parents see information appropriate to their role and relationship: coaches see their teams' athletes; parents see their linked children; athletes see messages addressed to them.

• Service providers (subprocessors). We use vetted providers — for example, cloud hosting, payment processing, error diagnostics, and transactional email delivery — under written agreements that restrict them to processing data on our documented instructions and to standards no less protective than those we commit to. A current list is available to educational-agency customers on request.

• Legal and safety. We may disclose information where required by law, regulation, legal process, or governmental request, or where necessary to protect the rights, property, or safety of PowerPlayer, our users, or others.

 

We do not share personal information for any third party's independent marketing.

6. Children's privacy

PowerPlayer is used by athletes who may be minors. For minors, accounts and data are handled under a school/parental-consent model (including reliance on the COPPA school-consent exception where applicable): a coach or parent establishes the athlete's participation, and coach-to-minor messages are visible to the linked parent. The Power Player, Inc. does not knowingly collect personal information directly from children outside this school/parental-consent structure. A parent or educational agency may review, request deletion of, or decline further collection of a minor's information by contacting us using Section 11.

7. Security

The Power Player, Inc. maintains administrative, physical, and technical safeguards designed to protect personal information against unauthorized access, use, alteration, and disclosure. Where PowerPlayer is used by or on behalf of an educational agency, the security requirements of the applicable data-privacy agreement govern.

8. Educational-agency data (student data privacy)

Where PowerPlayer is used by or on behalf of an educational agency (for example, a school or school district), the educational agency is the owner and controller of the student data, and The Power Player, Inc. acts as its service provider/processor under the applicable data-privacy agreement (for example, an SDPC/NDPA agreement and any state exhibit such as New York Education Law §2-d). In the event of any conflict between this Policy and a signed data-privacy agreement, the data-privacy agreement governs the treatment of student data.

9. Data location

Personal information collected on behalf of an educational agency is stored and processed in the United States. We do not store educational-agency personal information outside the United States.

10. Data retention and deletion

We retain personal information only as long as needed to provide the Services or as required by law. Where an educational-agency data-privacy agreement applies, we dispose of or return student data on the agency's written request or on termination within the period the agreement specifies (for example, within 90 days under New York Education Law §2-d), and certify disposal. A parent or agency may request review or deletion of a minor's information as described in Section 6.

11. Your choices and rights

Depending on your jurisdiction and role, you may request access to, correction of, or deletion of your personal information, and may object to or restrict certain processing. For student data, requests are directed through the educational agency, which is the data owner. To exercise a right or ask a question, contact us using the details in Section 13.

12. Changes to this Policy

We may update this Policy from time to time. Material changes will be posted on this page with a revised effective date, and, where required, communicated to affected users or educational agencies. For educational-agency customers, changes affecting student data are handled under the applicable data-privacy agreement.
